Privacy Policy of the Sztuka Obecna Foundation

 

1. General information

This Privacy Policy sets out the rules for the processing and protection of personal data provided by Users in connection with their use of the website operating at the URL https://sztukaobecna.eu, hereinafter referred to as the Website.

 

2. Personal data administrator

The administrator of personal data contained on the Website, hereinafter referred to as the Administrator and Website Operator, is Fundacja Sztuka Obecna, with its registered office at ul. Wenecja 4A/1, 31-117 Kraków. Email address of the personal data administrator: fundacja@sztukaobecna.eu

 

3. Purposes and grounds for processing personal data

The Website collects information about users and their behavior by storing cookies on their devices. The Administrator collects and processes the personal data of Website Users for the following purposes:

  1. Analysis of traffic on the Website, keeping statistics (Article 6(1)(f) of the GDPR)
  2. Running a newsletter.
  3. Conducting direct communication.

 

4. Data retention period

The User’s personal data stored and processed by the Administrator for no longer than is necessary to perform related activities, in the scope of direct communication and newsletter communication.

 

5. Selected data protection methods used by the Operator

  1. The places where personal data is entered are protected at the transmission layer (SSL certificate). Thanks to this, personal data and login details entered on the website are encrypted on the user’s computer and can only be read on the target server.
  2. The operator periodically changes its administrative passwords.
  3. In order to protect data, the Operator regularly makes backup copies.
  4. An important element of data protection is the regular updating of all software used by the Operator to process personal data, which in particular means regular updates of programming components.

6. Hosting

  1. The website is hosted (technically maintained) on the operator’s servers: dhosting
  2. In order to ensure technical reliability, the hosting company keeps logs at the server level. The following may be recorded:
    • resources specified by a URL identifier (addresses of requested resources – pages, files),
    • time of inquiry,
    • time of sending the reply,
    • client station name – identification performed by the HTTP protocol,
    • information about errors that occurred during the execution of HTTP transactions,
    • URL address of the website previously visited by the user (referrer link) – if the transition to the Website took place via a link,
    • information about the user’s browser,
    • information about the IP address,
    • diagnostic information related to the process of ordering services independently via the website’s recorders,
    • information related to the handling of e-mail addressed to the Operator and sent by the Operator.

 

7. Data recipients

The recipients of Users’ personal data may be:

  1. Sztuka Obecna Foundation.
  2. Members of the Sztuka Obecna Foundation team.
  3. Entities processing data on behalf of the Administrator, e.g., IT service providers, marketing agencies.
  4. Entities authorized to obtain data under applicable law, e.g., law enforcement agencies or courts.

 

8. User Rights

  1. In certain situations, the Administrator has the right to transfer the User’s personal data to other recipients if it is necessary to perform activities related to communication via the newsletter or to fulfill the obligations incumbent on the Administrator. This applies to the following groups of recipients:
    • persons authorized by the Sztuka Obecna Foundation, employees, and associates who need access to personal data in order to perform their duties.
    • their duties,
    • hosting company,
    • mailing service providers,
    • company providing SMS messaging services,
    • companies with which the Administrator cooperates in the field of its own marketing,
    • couriers,
    • insurers,
    • law firms,
    • banks,
    • payment operators,
    • public authorities.
  2. The user has the right to request from the Administrator:
    • access to the User’s personal data,
    • their corrections,
    • removal,
    • processing restrictions,
    • and data transfer.
  3. The User has the right to object to the processing referred to in point 8.2 with regard to the processing of personal data for the purposes of the legitimate interests pursued by the Administrator, including profiling, whereby the right to object cannot be exercised if there are valid legitimate grounds for processing, overriding the interests, rights, and freedoms of the User, in particular the establishment, exercise, or defense of legal claims.
  4. The Administrator’s actions may be appealed to the President of the Personal Data Protection Office, ul. Stanisława Moniuszki 1A, 00-014 Warsaw.
  5. Personal data is not transferred from third countries within the meaning of data protection regulations. This means that it is not transferred by the Sztuka Obecna Foundation outside the European Union.

 

9. Information on the voluntary nature of providing data

Providing personal data and consenting to the Operator’s use of cookies is voluntary, but necessary for the Website to function.

 

10. Key marketing techniques

The operator uses statistical analysis of website traffic via Google Analytics (Google Inc., based in the USA). The operator does not transfer personal data to the operator of this service, only anonymised information. The service is based on the use of cookies on the user’s end device. With regard to information about user preferences collected by the Google advertising network, the user can view and edit information derived from cookies using the tool: https://www.google.com/ads/preferences/

  2. Cookies are IT data, in particular text files, which are stored on the Website User’s end device and are intended for use on the Website’s pages. Cookies usually contain the name of the website they come from, their storage time on the end device and a unique number.
  3. The entity placing cookies on the Website User’s end device and accessing them is the Website operator.

    • Provision of the proper functioning of the Website;

  1. Cookies can be managed through:
    • Appropriate settings for cookies in the web browser used by the User.
    • During the first session after launching the Website: defining and saving selected preferences.
    • During subsequent sessions after launching the Website: open the cookie dialogue box by clicking the button at the bottom right corner of the browser window.
  2. Disabling cookies necessary for maintaining user preferences may hinder the use of the Website.
